Who has ‘acquired rights’

You’ll have ‘acquired rights’ if you’re a:
lorry driver and got your vocational licence (C, C1, C+E and C1+E) before 10 September 2009
bus or coach driver and got your vocational licence (D, D1, D+E and D1+E) before 10 September 2008 - this includes a restricted vocational licence D(101) issued after 1991 and D1(101) issued before 1997

Doesn't look like VOSA are doing much at the moment to enforce DCPC, not all EU members have agreed I have heard, It will be interesting to see how this pans out.

Do you know when this became effective Rog - will have an impact on customers I already have, does mean they will have to do 35 hours periodic training before they can drive because the date for PCV has already passed

If they do not already have LGV dcpc then yes BUT I do not know if they have the option of doing initial instead - going to call them later today

Interesting senario ...
Driver has both LGV & PCV pre 1997 aquired rights and is currently driving C
They have done 21 hours of dcpc
They decide to go for D and pass it
The PCV dcpc aquired limit passed on 9th Sept this year
Does this mean they need to complete the other 14 hours dcpc before they can drive D commercially? ....... Hmmm ..... I think yes but will find out

In the senario above the driver would just need to complete the other 14 hours - as per DSA DCPC hotline


To answer CJs question - yes they will have to complete all 35 hours before being allowed to drive PCVs commercially and taking initial is not an option

Here's a question not related to DCPC but regarding minibus...if a post-97 B manual licence holder were to pass D1 in an automatic minibus, would they still be permitted to drive a manual minibus under the exemption of the D1 requirement that allows B licence holders WITHOUT D1 to drive such vehicles?

Under the current rules the answer is no - they would have a 78 ( automatic) restriction for hire and reward.
If the new proposed changes happen then the answer would be yes - the manual car licence would give manual on the minibus even when the test was taken in an auto.

The auto restriction would surely only be for hire and reward though, or when driving a D1 category vehicle over 3.5T?

I know the rules are a confusing mess but it would be insane if one could go from being allowed to drive a manual minibus on a B licence only to NOT being allowed to drive a manual minibus after passing D1 in an auto.

You can drive a minibus within the UK as long as the following conditions apply:

youre 21 or older
the minibus is used for social purposes by a non-commercial body
youve had your driving licence for at least 2 years
youre driving on a voluntary basis and the minibus is used for social purposes by a non-commercial body
the maximum weight of the minibus is not more than 3.5 tonnes (or 4.25 tonnes including specialist equipment for disabled passengers, eg a wheelchair ramp)
youre not towing a trailer

Even with an auto restricted D1 category on licence, surely you'd be allowed to drive a manual if all of the above conditions are met?

Correct - that is why I specified the hire or reward in my answer, the D1 with a 101 restriction would of course stay the same.
